Privacy Policy

Privacy Policy

Effective Date: May 9, 2025

Introduction

This Privacy Policy describes how "Last Call Liquors" and Ybor Hospitalities LLC located at 1507 E 7th Ave, Tampa, Florida (Ybor City) (hereafter "the Company," "we," or "us") collects, uses, and shares personal information through its website and services. Our website facilitates local alcohol sales for delivery and pickup to adults age 21 or over only, in compliance with applicable laws. By using our website or services, you acknowledge that you are at least 21 years of age and agree to the practices described in this Privacy Policy. We are committed to protecting your privacy and complying with Florida state laws and general U.S. privacy requirements related to alcohol sales and personal data.

Information We Collect

We collect various types of personal information from you in order to provide our services and comply with legal requirements:

  • Information You Provide Directly: When you create an account, place an order, or sign up for services, we ask for personal details such as your name, email address, phone number, and delivery address. For example, to process an alcohol purchase and arrange delivery, we will require your name, address and phone number (for order confirmation and delivery coordination). We also collect payment information (e.g. credit card number, expiration date, billing address) for order payment processing. Age verification data is collected as well – you must provide your date of birth (and possibly show a valid ID) to confirm you are of legal drinking age. If you choose to register an account, we will also collect the account credentials you create (such as username and password). If you subscribe to our newsletter or marketing emails, you will provide your email address (and optionally your name) for that purpose.

  • Age Verification Details: Because our services are restricted to those 21 or older, we implement age verification measures. This may include collecting your date of birth at account creation or checkout, and requiring presentation of a government-issued photo ID upon delivery or pickup. In some cases, for online orders, we may use a third-party identity verification service to confirm your age by checking the ID information you provide. Any information collected solely for age verification (such as your ID details) will be used only to verify your age and legal eligibility to purchase alcohol.

  • Information from Transactions: When you make a purchase or request a delivery/pickup, we maintain records related to the sale. This includes details of the items ordered, dates/times of orders, special instructions, and any communications with us regarding the order.

  • Communications: If you contact us with questions, requests, or customer support needs (whether by email, phone, or through web forms), we will collect the information you provide in those interactions. This may include your contact information and the content of your communications.

  • Automatically Collected Data: We also collect certain information automatically when you interact with our website or emails. This may include technical data such as your device’s IP address, browser type, device identifiers, and operating system. We gather information about your browsing actions on our site, such as pages or products viewed, the dates/times of visits, and referring URLs. For instance, we may log what products you searched or viewed and how long you visited certain pages to help improve our website. This automatic data collection is typically done through cookies and similar tracking technologies (described more below), and it helps us understand usage patterns and secure our site.

We will clearly indicate when personal information is requested, and you may choose not to provide certain information. However, note that if you decline to provide required details (for example, your age or payment information), we cannot provide our services or complete a sale. We endeavor to only collect data that is relevant and necessary for the purposes described in this Policy.

Age Verification and Eligibility (21+ Only)

No one under the age of 21 may use our website or services. We strictly enforce age restrictions in accordance with the law: it is illegal to sell alcoholic beverages to individuals under 21, and we take all necessary steps to comply with age-related sales laws. By using our site, you represent that you are at least 21 years old.

  • Age Gating on the Website: Our website may require you to affirm your date of birth or that you are 21 or older before allowing access. This is to prevent underage individuals from even browsing our offerings.

  • Identity Verification: Before completing any alcohol sale, we reserve the right to verify the age of the customer (through information collection or ID checks) in accordance with federal, state, and local laws. For delivery orders, our delivery personnel will check a valid government-issued photo ID at the time of delivery. The recipient must be 21 or older and the name on the ID may be recorded or matched against the order. If a valid ID is not provided at delivery or if the recipient is underage, the delivery will be refused and the order will be canceled. For pickup orders, you will also be asked to show ID at the store. In some cases, for added security, we may use a third-party age verification service for online orders; this could involve you submitting a photo of your ID or other information.

  • No Service to Minors: We do not knowingly collect personal information from anyone under 21 or allow underage persons to register an account or make purchases. If you are under 21, do not attempt to use or provide any information on this website. If we learn that we have inadvertently collected personal data from a person under 21, we will promptly delete that information (and, if applicable, cancel the associated account or order). We may also take steps to prevent such an individual from using our site in the future. Parents or guardians who believe their minor (under 21) may have provided us information should contact us so we can remove it.

  • Data Handling for Age Checks: Any personal information collected solely for age verification will be handled with care for your privacy. We and any third-party identity verification service we use will not store, share, or reuse your sensitive information beyond what is necessary to complete the age verification process. For example, if we scan or record details from your ID at delivery, it will only be used to verify age and not retained in our system afterwards. We comply with applicable data privacy laws (such as GDPR, CCPA, and relevant U.S. laws) when conducting age checks. The Company also reserves the right to refuse service if a customer fails or refuses to complete the required age verification, or if we suspect an ID is fraudulent or the purchase is intended for someone underage (so-called "straw purchasing").

By adhering to these measures, we ensure that our alcohol sales are restricted to legal adults and that we remain compliant with Florida and U.S. regulations concerning age restrictions on alcohol. If you are not 21 or older, you are strictly prohibited from using this website or our services.

How We Use Your Information

We use the personal information we collect for the following purposes, all in accordance with applicable laws:

  • To Process Orders and Provide Services: We use your information to process transactions that you have requested — for example, to fulfill your purchase orders, arrange for delivery or pickup of your items, and provide you with the products you’ve bought. This includes using your name and address for delivery, your payment information to charge for the order, and your phone or email to send order confirmations and updates. We also use your age or date of birth to verify that you are of legal drinking age before completing the sale. Without this information, we cannot complete the transaction or deliver the product to you.

  • Account Management: If you create an account on our website, we use your information to set up and maintain your user account. This allows you to log in, review your order history, save preferences (like saved addresses or payment methods), and manage your settings. We use your login credentials to authenticate you, and your contact information to communicate regarding account activities.

  • Communication: We may use your contact information (email, phone, or mailing address) to communicate with you about your orders or inquiries. For example, we send email or text confirmations when you place an order, and we may contact you if there is an issue with your order or to notify you when a delivery is on the way. We also respond to any customer service requests or questions you send us using your provided contact details.

  • Marketing and Newsletters: With your consent or as otherwise permitted, we will use your email address (and/or phone number, if you opt in to SMS) to send you promotional communications about our store, such as newsletters, special offers, new product updates, or events. These communications will be sent in accordance with applicable marketing laws and you can opt out at any time (see the Email Newsletters and Marketing section below for more details). We will not spam you; we only send marketing messages to users who have subscribed or agreed to receive them, or in some cases, to past customers in line with legal allowances for customer relationships.

  • Analytics and Improvements: We use data about how users navigate and use our website to understand what is working and what could be improved. For instance, information like pages visited, time spent on the site, and purchase history helps us analyze trends and improve our website, products, and services. We might use Google Analytics or similar tools to gather this information and to test new features. This usage data is typically aggregated and does not directly identify individuals; it helps us optimize the user experience, customize content, and develop new features that align with user interests.

  • Security and Fraud Prevention: We use personal information to protect the security and integrity of our business. For example, we may use certain data to verify identity, prevent fraud or theft, and ensure that our alcohol sales comply with the law (such as preventing underage purchases). If we notice suspicious activity (like repeated failed age verification attempts or payment fraud indicators), we may use personal data to investigate or mitigate such risks. This also includes using information to enforce our terms and conditions and legal rights, and to ensure our deliveries are received by the correct, eligible individuals.

  • Legal Compliance and Record-Keeping: We may use your information as necessary to comply with various legal obligations. For instance, Florida law may require us to maintain certain records of alcohol sales and deliveries. We will use and retain transaction information (including personal details of the purchaser and recipient) to satisfy regulatory requirements, tax and accounting obligations, and any reporting duties. Additionally, if we are required by law to verify age or identity for each alcohol transaction, we use your information for that purpose as described in the Age Verification section. We also use personal information to handle any legal issues such as responding to valid law enforcement requests or court orders.

We will not use your personal information for purposes unrelated to the above without informing you and obtaining your consent when required. We limit our use of the data to what is necessary and relevant for our legitimate business purposes or as required by law. If we ever need to process your personal data for a new purpose not described in this Privacy Policy, we will update this Policy and notify you as needed or seek your consent.

How We Share Your Information

We value your privacy and do not sell or rent your personal information to third parties for their own marketing purposes. However, in the normal course of running our business and complying with laws, we may disclose (share) certain personal information with third parties under the following circumstances:

  • Service Providers (Processors): We share personal information with trusted third-party companies that perform services on our behalf. These include, for example:

    • Payment Processors: We use third-party payment gateways to securely process credit card transactions (see "Payment Processors" below for more detail). Your payment details are submitted directly to these processors.

    • Delivery Partners: If we engage courier services or delivery drivers, we provide them with the information needed to fulfill the delivery (such as your name, address, and order contents) so they can deliver your purchase to you. They are required to verify ID at delivery but must not retain your personal info beyond confirming the delivery.

    • ID Verification Services: For online age or identity verification, we may use a specialized third-party service. In such cases, information like your name, date of birth, or a scan of your ID may be shared with the verification provider solely to confirm your age. These partners are contractually bound to use the data only for verification and not to store or reuse it after verifying compliance.

    • Email and Marketing Platforms: If you sign up for our newsletter or promotions, we may use an email marketing service to send out those emails. We provide your email address (and name, if applicable) to that platform to distribute our communications to you. They are not allowed to use your email for any purpose other than sending our messages.

    • Website Analytics: We may use third-party analytics companies (like Google Analytics) to collect and analyze information about site usage and performance. These providers use cookies or similar tech to gather usage data on our behalf (e.g., tracking page views or clicks). This helps us improve the website. Analytics providers generally only receive de-identified or aggregated data, not your name or contact info. (See “Analytics Tools” below for more detail.)

    • In all cases, our service providers are given only the information necessary for them to perform the contracted service. We require these third parties to protect your personal information and keep it confidential. They are not permitted to use your data for any independent purposes outside of what we’ve contracted them for.

  • Legal Compliance and Protection: We may disclose personal information when we believe it’s legally necessary or appropriate to do so. This includes:

    • To comply with laws or legal process: If we are subject to a subpoena, court order, law enforcement request, or other legal obligation to produce data, we may disclose the required information. For example, Florida regulators or law enforcement might request proof of age verification for a particular sale; we would provide the necessary information as required by law.

    • To enforce our rights and agreements: If needed to enforce the terms and conditions of our website or to collect debts owed, we might share information (for example, providing information to a collections agency for an unpaid balance, or to our attorneys).

    • To protect safety and prevent fraud: We may disclose information when we believe it is necessary to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the safety of any person, or violations of our policies or the law. This could include exchanging information with other companies or organizations (and government authorities) for fraud protection and risk reduction.

  • Business Transfers: If our business is involved in a merger, acquisition, sale of assets, reorganization, financing, or other transaction, personal information may be transferred to a successor or affiliate as part of that deal. For example, if the ownership of the liquor store changes or if we sell our online business operations, customer information (including personal data) would likely be one of the assets transferred to the new owner so that the service can continue. In such events, we will ensure that your information remains protected and subject to equivalent privacy commitments, and we will notify you of any change in data ownership if required by law.

  • With Your Consent: We may share your information with third parties if you direct us to or expressly consent to such sharing. For instance, if you opt-in to a co-promotional event or partnership that requires us to share your info with another company, we will do so only with your knowledge.

Aside from the situations above, we will not disclose your personal information to third parties. Specifically, we do not sell personal data to data brokers or third-party marketers. Any sharing of data is solely in service of providing our website features, completing your orders, complying with the law, or protecting our rights as outlined. We strive to ensure any third party that receives personal information from us is bound to protect it and to use it only for the purposes for which it was provided.

Third-Party Services and Tools

In operating our e-commerce platform, we rely on several third-party services to perform essential functions. Below is more detail on how we work with these third parties and what that means for your personal information:

Payment Processors

We use secure third-party payment processing services to handle credit/debit card transactions on our website. When you provide payment information at checkout (such as your card number), that data is transmitted directly to our payment processor via an encrypted connection. We do not store your full credit card number or CVV on our own servers. For example, our systems may only retain a payment "token" or the last four digits of your card for reference, while the actual card details are stored securely by the payment processor. This means that after your transaction is completed, we cannot access your full card number – it is kept inaccessible to us and protected by the processor.

Our payment processors are PCI-DSS compliant (adhering to Payment Card Industry Data Security Standards) and employ robust security measures to safeguard your payment data. They use your payment information solely to process authorized transactions and to fulfill any legal or regulatory requirements related to payments (like fraud screening or refund processing). These companies do not use your payment details for any marketing or purposes unrelated to processing your order.

By making a purchase, you consent to your payment information being processed by these third parties. If you have any questions about how they handle your data, you can refer to the privacy policy of the specific payment processor we use (which we can provide upon request, e.g., Stripe, Square, PayPal, etc., depending on which is in use).

Analytics Tools

We use third-party analytics tools (such as Google Analytics) to collect information about how visitors use our website. These tools use technologies like cookies and scripts to automatically gather data on site usage (e.g., what pages users visit, how long they stay, how they arrived at our site, and what actions they take). The information collected through analytics is generally not personally identifying — it focuses on user behavior and trends. For instance, Google Analytics provides us with aggregated statistics that help us understand website traffic and improve our service, but it does not reveal the identities of individual visitors.

Analytics providers may collect your device’s IP address and other technical identifiers, but we have configured these services, where possible, to anonymize or truncate data to protect your privacy. We use the insights from analytics to improve website functionality, user experience, and to guide our marketing strategies (for example, determining which products are most viewed can inform what we promote).

If you prefer not to be included in Google Analytics data collection, you can install the Google Analytics Opt-out Browser Add-on or use your browser's Do Not Track features. Additionally, you can disable cookies as described below in the Cookies section (though note that doing so may affect analytics functionality). We do not combine analytics data with any personal information (like name or email) that you provide to us, so analytics data remains de-identified.

Marketing and Advertising Platforms

The Company may use third-party marketing platforms to help deliver promotional content and advertisements, both via email and potentially on other websites. For example, we might use an email marketing service (like MailChimp, Constant Contact, or similar) to manage our newsletter list and send out emails. In doing so, we provide your email address and sometimes your name to that platform. They operate under our instructions and cannot use your data except to send out our communications. Every marketing email you receive from us will contain an unsubscribe link or instructions to opt-out, in compliance with the CAN-SPAM Act.

We might also participate in online advertising networks such as Google Ads or Facebook Custom Audiences to show you ads for our store on other websites or social media. If we do this, we might share a hashed (encrypted) version of your email or phone number with the platform to try to match it with your user account on that platform (for example, to show an ad on Facebook to our existing customers). This information is obscured and only used to identify audiences for our ads; the platforms do not get plain-text personal info from us in that process. Alternatively, these advertising partners use cookies on our site to collect information about your browsing (as described in the Cookies section) and then serve relevant ads. You have choices to opt out of such interest-based advertising (see Cookies/Tracking below for opt-out options).

Importantly, any marketing or advertising partners we use will be bound to protect your data and cannot claim ownership of it or use it beyond providing services to us. We do not give advertisers your sensitive personal details; at most, we utilize these tools to send our offers to you or people like you (for instance, showing an ad to users in the Tampa area who have visited our site). If you prefer not to receive targeted ads from us on third-party platforms, you can opt out through industry programs like the Digital Advertising Alliance’s YourAdChoices website or by adjusting your privacy settings on those platforms.

User Accounts

Creating a user account on our website is optional, but it can enhance your shopping experience. If you choose to register an account, we will collect and store the personal information you provide during registration (such as name, email, password, date of birth, etc.) in order to maintain your profile. We use this information to recognize you on return visits and to make checkout faster (by recalling your saved addresses or payment methods, if you choose to save them) and to display your order history.

Your account password is stored in a protected manner (we use encryption or hashing so that it’s not stored in plain text) to help keep your account secure. You are responsible for maintaining the secrecy of your login credentials and for any actions taken under your account. Please choose a strong, unique password and do not share it with others. If you believe your account has been compromised, contact us immediately so we can assist in resetting access.

Within your account settings, you may be able to update or correct certain personal information at any time (such as updating your contact info or password). Keeping your information up-to-date helps us serve you better (for example, having your current address prevents delivery mistakes).

You may also request to delete your account by contacting us (see Contact Us section). Deleting your account will remove your profile information from our active user database, though we may retain transaction records associated with your account as required for legal, tax, or legitimate business purposes (see Data Retention below). Also note that if you have subscribed to our newsletter, you will need to unsubscribe separately from account deletion.

Email Newsletters and Marketing Communications

If you subscribe to our newsletter or promotional emails, we will use your email address (and possibly your name for personalization) to send you updates about our store. These may include information on new products, special promotions, events, or other news related to our liquor store. We will send you such communications only if you have opted in to receive them, such as by checking a subscription box during checkout or entering your email in a signup form. If you are a customer who provided your email during a purchase, we may send you occasional product recommendations or offers, but you will always have the ability to opt out.

Opt-Out: You have the right at any time to stop us from contacting you for marketing purposes. Every marketing email we send includes a clear "unsubscribe" link in the footer. By clicking that link and confirming, you will be removed from our marketing list (please allow a short time for processing). You can also opt out of marketing emails by contacting us directly and requesting to be removed. Once you opt out, we will cease sending you promotional communications. (Do note that even if you opt out of marketing, we may still send you transactional emails about your orders or account – those are not promotional, but rather necessary for service.)

We do not share your contact information with third parties for their own marketing. Any email marketing is conducted by us (or our contracted email service provider as explained) and pertains to our own offerings. We comply with all applicable regulations (such as the U.S. CAN-SPAM Act) which gives you the right to opt out and requires honest subject lines and identification of the sender. If you feel you have received an email from us in error or that is unsolicited, please let us know so we can address the issue.

Cookies and Tracking Technologies

Our website uses cookies and similar tracking technologies to provide and improve our services. Cookies are small text files stored on your browser or device when you visit a website. We use cookies for a variety of functions:

  • Essential Cookies: These are necessary for the website to function properly. For example, they help keep you logged in during your visit, remember items in your shopping cart, and enable the checkout process. Without these cookies, basic e-commerce features may not work.

  • Preference Cookies: These remember your choices and settings to give you a more personalized experience. For instance, a cookie may save your age verification confirmation so that you don’t have to repeatedly verify your date of birth on each page, or remember your language or region preference.

  • Analytics Cookies: These cookies collect information about how visitors use our site (as discussed in the Analytics section above). They allow us to see which pages are popular, track conversion rates, and gather other statistical information. The data collected is aggregated and anonymous – it does not personally identify you.

  • Advertising/Marketing Cookies: We may use these to track browsing habits and activity to deliver relevant ads or promotions. For example, a cookie might note that you browsed our whiskey section, and this could allow us to show you a promotion for whiskey on a partner site. Any advertising cookies on our site would typically be placed by third-party advertising networks (with our permission). We would use such cookies to reach people who have shown interest in our site, and to limit how often you see an ad. These cookies may collect information about your browsing across multiple sites over time. (Please note: as of now, our local store’s online advertising is limited, but we mention this for completeness.)

  • Social Media Cookies: If our site integrates with social media (such as a Facebook “Like” button or Instagram feed), those services may set cookies to recognize you or track interactions. This would apply if you choose to log in via a social account or share content from our site onto your social profile.

When you first visit our website, you may see a notice about cookies and be given the option to accept or adjust your cookie settings. By continuing to use our site, you consent to our use of cookies as described.

Your Choices for Cookies: You can control or delete cookies through your web browser settings. Most browsers allow you to block cookies or to alert you when cookies are being sent to your device. You can also usually delete cookies that have already been set. Please be aware, however, that if you disable cookies entirely, some parts of our website may not function properly – for example, you might not be able to add products to your cart or proceed through checkout. We recommend leaving essential cookies enabled to ensure you can use all features of our service.

For advertising cookies, aside from using browser settings, you can opt out of many third-party cookies used for interest-based advertising through sites like the NAI (Network Advertising Initiative) or DAA (Digital Advertising Alliance) opt-out pages. (Choices you make are typically browser-specific, so if you use multiple devices or browsers, you’ll need to set preferences on each.)

Our site also respects global privacy signals like “Do Not Track (DNT)” to the extent required by law. However, not all tracking on our site is controlled by us (for example, third-party analytics), so a universal DNT solution is not guaranteed.

Data Security

We take the security of your personal information seriously and implement reasonable security measures to protect it from unauthorized access, alteration, disclosure, or destruction. These measures include technical, administrative, and physical safeguards appropriate to the sensitivity of the information. For example:

  • The website uses SSL/TLS encryption (HTTPS) to secure data transmissions. This means that any personal information (like your login credentials or payment details) you provide through our checkout or account pages is encrypted in transit to prevent eavesdropping.

  • We restrict access to personal data on a need-to-know basis. Only authorized personnel and service providers who require the information to perform their duties (e.g., fulfilling orders or assisting you) will have access to your data. They are contractually obliged to keep it confidential.

  • We store data on secure servers, and maintain up-to-date firewall, anti-malware, and monitoring solutions to guard against external threats.

  • Passwords are stored in encrypted form, and we encourage you to use a strong password unique to our site to enhance security on your side.

  • For payment information, as noted, we do not store full credit card numbers on our systems to further reduce risk. Our payment processors are certified to handle that data securely.

  • We have policies and training for our staff on how to handle personal information safely and securely.

Despite our efforts, please understand that no method of transmission over the internet, or method of electronic storage, is 100% secure. While we strive to protect your personal data, we cannot guarantee absolute security. Cyber threats evolve rapidly, and there is always some risk that a breach could occur. However, we follow industry best practices and Florida’s requirements (such as the Florida Information Protection Act, which mandates reasonable measures to secure personal data in electronic form) to minimize the risk of unauthorized access. In the unlikely event of a data breach affecting your personal information, we will comply with applicable laws in notifying you and the relevant authorities about the incident.

By using our site and providing personal information, you acknowledge that you understand the inherent risks of online data transmission and storage. We continuously review and enhance our security practices to adapt to new threats and to protect your privacy.

Data Retention

We will retain your personal information only for as long as necessary to fulfill the purposes outlined in this Privacy Policy or as required by law. This means:

  • Customer and Account Data: If you have an account with us, we retain your personal information for as long as your account is active. If you close your account, we will remove or anonymize your account data within a reasonable time after the closure, except for any information we need to retain for legal reasons. If you make a purchase without an account (guest checkout), we retain the information related to that transaction for the needed period (see below).

  • Order and Transaction Records: We keep records of purchases, deliveries, and payments to comply with our business record-keeping obligations, tax requirements, and potential audit or legal needs. Typically, we might retain sales records for a number of years (for example, sales records may be kept for at least X years as required under Florida law or standard accounting practices – usually 3-7 years). After the retention period, we will securely delete or anonymize those records. If there's data we only need for internal analysis, we may anonymize it (so it can no longer be associated with you) and retain it in an aggregate form.

  • Marketing Data: If you have subscribed to our marketing communications, we retain your contact info for that purpose until you unsubscribe or request deletion. If you opt-out, we may keep your email on a suppression list to ensure we honor your opt-out (as required by law) but will not use it to send you further emails.

  • Age Verification Records: We generally do not keep detailed age verification data longer than needed to confirm compliance for each order. We may keep a note or flag that an age check was completed for an order/delivery, but not retain a copy of your ID. However, if a particular transaction or user is under review for legal compliance, we might retain relevant age verification data as evidence of compliance with the law. In any case, such data would not be kept longer than necessary for that compliance purpose.

  • Legal Holds: If we are involved in a legal matter or if retention is required by law (for instance, to comply with a regulatory inquiry, or if we have to preserve information due to a litigation hold), we will retain the information as needed until the issue is resolved.

After the applicable retention period has ended, and there is no longer a need or legal obligation to keep your data, we will securely dispose of it. This may involve deleting electronic records, securely erasing storage devices, and shredding any physical documents containing personal information. We aim to ensure that personal data is not kept longer than necessary in order to reduce the risk of outdated or irrelevant data being compromised.

Your Rights and Choices

You have certain rights regarding your personal information and choices about how we use it. We are committed to honoring your rights under applicable privacy laws. These rights and choices include:

  • Access and Portability: You have the right to request a copy of the personal information we hold about you. We can provide this to you in a common electronic format. This is sometimes known as a "data subject access request." This allows you to see what data we have collected about you.

  • Correction (Rectification): If any of your personal information is inaccurate or outdated, you have the right to request that we correct or update it. For example, if you move or change your phone number, you can update your account information, or ask us to do so on your behalf. We want to ensure we have correct, up-to-date information.

  • Deletion (Right to Erasure): You can request that we delete your personal information. For instance, you may ask that we delete your account and remove personal details. We will honor such requests to the extent possible; however, please note there may be exceptions – we might retain information that we are required by law to keep or that is necessary for legal disputes, fraud prevention, or enforcement of our agreements. If full deletion isn’t possible (for legal reasons), we will inform you and will only retain the data for the required purpose, not for other uses.

  • Opt-Out of Marketing: As described above, you can opt out of receiving promotional emails or texts at any time. You also have the right to object to our use of your information for direct marketing purposes. We make it easy to unsubscribe via the link in our emails or by contacting us.

  • Opt-Out of Analytics/Tracking: You can limit the data collected by cookies and third-party tools by adjusting your browser settings or using provided opt-outs (see Cookies section). While not a traditional "right" in law, it is a privacy choice we fully support.

  • Non-Discrimination: If you exercise any of your privacy rights, we will not discriminate against you or deny you services. For example, if you choose to opt out of marketing emails or request deletion of your data, we will not treat you adversely in terms of the pricing or services we offer. (Do note that if deletion of certain data makes it impossible for us to continue providing service – e.g., deleting your account data when you still want to order – we will inform you of that conflict.)

These rights may vary based on your jurisdiction. For instance, residents of certain states (such as California, under the California Consumer Privacy Act (CCPA), or Florida, under the Florida Digital Bill of Rights effective July 2024) and residents of the European Union (under the General Data Protection Regulation (GDPR)) may have additional rights or specific processes to exercise them. This can include rights like objecting to processing, withdrawing consent (if processing is based on consent), or appealing a decision we make regarding a rights request. We extend the spirit of these rights to our users generally: regardless of your location, you can contact us with any privacy-related request and we will do our best to accommodate it in line with applicable law.

To exercise your rights or make any requests regarding your personal data, please contact us using the information provided in the Contact Us section below. We may need to verify your identity before fulfilling certain requests (for example, to ensure that we don't disclose your data to someone impersonating you). Verification might involve checking information we already have on file, or asking you to provide additional proof of identity. We will respond to your request within the timeframe required by law (typically within 30-45 days for many requests, and we will inform you if we need an extension).

Compliance with State and Federal Privacy Laws

We strive to comply with all applicable privacy laws and regulations. This includes general laws that apply to personal information as well as those specific to the alcohol industry. Some of the frameworks and laws we adhere to include:

  • Florida Privacy Law: We operate in Florida, and we follow the Florida Information Protection Act (FIPA) which requires us to implement reasonable security measures to protect personal information and to notify individuals in the event of certain security breaches. We also are aware of Florida’s recently enacted consumer privacy provisions (Florida Digital Bill of Rights, effective 2024) and, although our business may not meet the thresholds to be legally mandated by all of its provisions, we aim to honor the core privacy rights it grants to Florida residents (as described in Your Rights above). We do not sell personal data, which aligns with these new standards.

  • Other State Laws: If our services are used by residents of other states with privacy laws (such as California’s CCPA/CPRA, Virginia’s VCDPA, Colorado’s CPA, etc.), we intend to comply with those laws to the extent they apply. For example, California residents can request a Notice of Collection and have the right to know, delete, and opt-out of sale/sharing of personal info. While we do not sell personal data, we will honor verifiable requests by California residents to access or delete data as required. We extend similar courtesy to residents of other states listed in the Your Rights section.

  • Alcohol-Specific Regulations: Federally and in Florida, selling alcohol comes with responsibilities, like verifying age (21+) and not marketing to minors. We ensure our marketing practices target only adults of legal drinking age and avoid any appeal to minors. We comply with the federal Children’s Online Privacy Protection Act (COPPA) by not collecting data from anyone under 13, and we voluntarily extend a higher age cutoff (21) given the nature of our business. We also follow any FTC guidelines on advertising alcohol online, and any industry self-regulatory codes for responsible alcohol marketing.

  • International Users: Our website and services are intended for customers within our local service area (Florida, USA). We do not actively target or market to individuals outside the United States. However, if you are accessing our site from outside the U.S., be aware that your information will be processed in the U.S. where our servers and operations are located. For European Union users, we do not presently offer services to the EU, but if we inadvertently collect any EU personal data, we will handle it in accordance with GDPR principles. For example, EU users would have rights to access or delete data, and we would ensure a legal basis (such as consent or legitimate interest) for any processing of their data. We also honor requests related to GDPR (like the right to restrict processing or data portability) if applicable.

If you have any questions about our legal compliance or want more detail on how a specific law may apply to your data, you can always reach out to us. We keep this policy updated to reflect our compliance efforts and any changes in the law.

Third-Party Links and Features

Our website may contain links to external websites or include embedded content/features from third parties (such as an embedded map for our store location, or social media buttons). Please be aware that this Privacy Policy applies only to our website and practices. If you click a link to another website or interact with a third-party service, any data you provide to them or that they collect is governed by their respective privacy policies, not ours. We encourage you to review the privacy policies of any third-party sites or services you visit through links on our site. We are not responsible for the privacy practices of other companies.

For example, if we have a link to a delivery partner or a recommendation to visit a wine producer’s site, and you follow that link, any information collected on that external site is outside of our control. Similarly, if you use a social media feature (like sharing a product on Facebook), that action may be logged by the social network under their terms. We will not knowingly frame or embed content in a way that shares your personal information without your interaction, but some third-party tools (like a Google Map showing our store) might collect usage data (e.g., your IP or location) under their own policies. By using those features, you consent to the third parties’ practices as well.

Changes to This Privacy Policy

We may update or modify this Privacy Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. If we make changes, we will post the updated policy on this page with a new Effective Date, and those changes will become effective immediately upon posting (unless otherwise indicated). We encourage you to review this Privacy Policy periodically to stay informed about how we protect and use your information.

If the changes are significant or if required by law, we will provide a more prominent notice or seek your consent where applicable. For example, if we were to start collecting additional types of personal data or using your data in a materially new way, we might notify you via email or a website banner and obtain any required consent.

Your continued use of our website or services after any modifications to this Privacy Policy constitutes your acceptance of the updated terms. If you do not agree to any update, you should stop using our services and you may contact us to exercise your rights (for instance, to have your data deleted).
